Requesting an inquest
Anyone can ask the coroner to hold an inquest into a death.
If you wish to formally request an inquest, under section 24 of the Coroners Act 1996 (WA), you must make that request in writing to the Coroner and state the reasons why you seek an inquest. In making this request, it is important to consider the Coroner’s role.
If a request for an inquest is made, it will be considered by a coroner. The Coroner will either approve the request and hold an inquest or decline the request, stating the reasons why the request has been declined.
If you are not satisfied with the Coroner’s decision, you may make an application to the Supreme Court of Western Australia for an inquest to be held. The Supreme Court may make an order that an inquest be held if it is satisfied that it is necessary or desirable in the interests of justice.
